9.1             Our Website is directed to people residing in the United Kingdom. We do not represent that content available on or through our site is appropriate for use or available in other locations. If you reside outside the United Kingdom, please navigate to the site relevant to your location using the selector tool available in our Website header.

14.1          Our Website may include information and materials uploaded by other users of the Website such as product reviews. This information and these materials have not been verified or approved by us. The views expressed by other users on our Website do not represent our views or values.

15.1          If you wish to complain about content uploaded by other users, please contact us using the contact details in Section 2.2. above

16.             Our responsibility for loss or damage suffered by you

16.1          We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

16.2          Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products to you, which will be set out in our Terms and Conditions.

18.             Prohibited Uses

18.1          You may use our Website for lawful purposes only. You may not use our Website:

(b)              In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.

(c)              For the purpose of harming or attempting to harm minors in any way.

19.             Uploading content to our Website

19.1          Whenever you make use of a feature that allows you to upload content to our Website, that contribution must:

(a)              Be accurate (where it states facts).

(b)              Be genuinely held (where it states opinions).

(c)              Comply with the law applicable in England and Wales and in any country from which it is posted.

19.2          A contribution must not:

(m)            Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.

(n)              Be likely to harass, upset, embarrass, alarm or annoy any other person.

(o)              Impersonate any person, or misrepresent your identity or affiliation with any person.

(p)              Give the impression that the contribution emanates from REP Fitness UK, if this is not the case.

(q)              Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.

(r)               Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.

(s)              Contain any advertising or promote any services or web links to other sites.

19.3          Fake reviews are not allowed on our Website. Fake reviews include reviews that conceal that the reviewer has been incentivised in some way to post the review, or where the review contains information that is false or misleading.

19.4          You promise that any such contribution does comply with the above standards, and you will compensate us in full for any breach of that promise. This means you will be responsible for any loss or damage we suffer as a result of your breach of that promise.

19.5          Any content you upload to our Website will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of our Website a limited permission to use, store and copy that content and to distribute and make it available to third parties.

19.6          We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our Website constitutes a violation of their intellectual property rights, or of their right to privacy.

20.             Breach of these terms

20.1          When we consider that a breach of these terms has occurred, we may take such action as we deem appropriate.

20.2          Failure to comply with the 'Prohibited Uses' or 'Uploading content to our Website sections above constitutes a material breach of these terms and may result in our taking all or any of the following actions:

(a)              Immediate, temporary or permanent withdrawal of your right to use our Website.

(b)              Immediate, temporary or permanent removal of any contribution uploaded by you to our Website

(c)              Issue of a warning to you.

(d)              Legal proceedings against you for reimbursement of all costs, on a full compensation basis (including reasonable administrative and legal costs), resulting from the breach.

(e)              Further legal action against you.

(f)               Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

20.3          We exclude our liability for all action we may take in response to breaches of these terms of use. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

21.1          When you upload or post content to our Website, you grant us the following rights to use that content:

(a) Non-exclusive, royalty-free copyright licence to display and share the content.

(b) Moral rights waiver and consent to edit and/ or shorten the content.

(c) Right to reproduce images and likeness.

(d) Right to reproduce and re-post the content in our marketing.

(e) Right to reproduce and re-post the content on social media.

22.            We are not responsible for viruses and you must not introduce them

22.1          We do not guarantee that our Website will be secure or free from bugs or viruses.

22.2          You are responsible for configuring your information technology, computer programmes and platform to access our Website. You should use your own virus protection software.

23.             Rules about linking to our Website

23.1          You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

23.2          You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

23.3          Unless otherwise permitted, you must not establish a link to our Website in any website that is not owned by you.

23.4          Our Website must not be framed on any other site.

23.5          We reserve the right to withdraw linking permission without notice.

24.             Which country's laws apply to any disputes?

24.1          Please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

25.             Our trade marks are registered
